FAQs

Wadeema’s Law is the common name for Federal Law No. 3 of 2016 Concerning Child Rights in the UAE. Its purpose is to protect children from all forms of abuse—whether physical, psychological, or sexual—as well as from neglect by parents or guardians. The law affirms the child’s rights to education, healthcare, and protection from exploitation or forced labor, and criminalizes any action that harms a child.
Under the Personal Status Law, custody is generally granted to the mother if she is legally and morally fit, until the child reaches the legal custody age—unless the court finds that the child’s best interest requires otherwise. With recent amendments, procedures may differ for non-Muslims or foreigners, particularly in Abu Dhabi, where civil family laws may apply.
A legal claim to establish or deny paternity may be filed before the Sharia Court, supported by admissible evidence, including DNA testing when necessary. Such cases require legitimate grounds and are subject to judicial review.
The process involves filing a petition with the competent court to request alimony for a spouse or children, along with financial records and documentation of expenses. The court will review the case and issue a judgment, which may be enforced by the Execution Department if the obligated party fails to pay.
Penalties vary depending on the violation and may include: Fines of up to AED 1,000,000 Imprisonment for serious neglect or intentional abuse Protective measures, such as the removal of the child from the harmful environment Revocation of custody from negligent or abusive parents
