What is a Trademark?
A trademark is any distinctive sign, including names, words, signatures, letters, numbers, drawings, symbols, packaging, or combinations thereof, used to distinguish the goods or services of one party from those of others. It is an essential tool in establishing a business’s reputation and identity in the market.
Functions of a Trademark
Trademarks serve several key legal and commercial functions, including:
- Identifying the source of products or services: Helping consumers recognize the origin.
- Symbol of trust and consistent quality: Reflecting the reliability of a product or service.
- Marketing and advertising tool: Enhancing brand recognition and consumer loyalty.
- Means of fair competition: Helping businesses stand out in local and international markets.
Types of Trademarks
Under UAE law, trademarks are categorized as:
- Trade mark: Placed by wholesalers or traders on goods.
- Industrial mark: Used by manufacturers to distinguish their products.
- Service mark: Distinguishes services, such as those provided by courier companies.
- Product mark: Identifies a specific product of a particular business.
It is important to differentiate between a “trademark” (legal term) and a “brand” (broader commercial identity).
Trademarks Not Eligible for Registration
Certain trademarks are not registrable in the UAE, including:
- Generic or non-distinctive marks.
- Marks that violate public order or morals.
- State emblems, flags, or imitations thereof.
- Marks that resemble or translate famous trademarks and may confuse consumers.
Responsible Authority
The Ministry of Economy is the competent authority for trademark registration in the UAE. It maintains a public register of all trademarks, their owners, business activities, and any legal changes such as transfers or licenses.
Who Can Register a Trademark?
- UAE nationals (individuals or companies).
- Foreign individuals or entities conducting business in the UAE.
- Foreign applicants from countries with reciprocal agreements.
- Public entities and government bodies.
Trademark Disputes and Similar Marks
A trademark identical or similar to an existing registered mark cannot be registered if it is likely to cause confusion or harm the interests of the original trademark owner.
Trademark Cancellation
The Ministry may cancel a trademark registered in bad faith after notifying the concerned parties and giving them the opportunity to present their defense. The decision can be appealed in court within 30 days.
Penalties for Trademark Infringement
Violators may face imprisonment or fines not less than AED 5,000, or both, in cases such as:
- Forging or counterfeiting a registered trademark.
- Knowingly using a forged or counterfeit mark.
- Selling or offering goods with a false trademark.
