Industrial Property and Patent Registration in the United Arab Emirates

The protection of industrial property rights is a key pillar for promoting innovation and investment in the UAE. Federal Law No. (11) of 2021 governs all aspects related to patents, utility certificates, industrial designs, layout designs of integrated circuits, and undisclosed information.

  • What is a Patent?

A patent is a legal document that grants the inventor exclusive rights to exploit their invention for a limited time in exchange for public disclosure. Patents are granted for new inventions based on an innovative idea or a technical improvement, provided the invention is:

  • Novel
  • Involves an Inventive Step
  • Industrially Applicable

Excluded from Patent Protection:

  • Scientific discoveries, principles, or theories.
  • Medical or surgical methods.
  • Plant/animal species and biological methods of production.
  • Computer programs and abstract business methods.
  • Inventions that violate public order or morality.

Patent Registration Procedure in the UAE:

Handled by the International Centre for Patent Registration under the Ministry of Economy. Steps include:

  • Submit the application and documents via the online portal.
  • Pay the official fees electronically.
  • The application is examined by technical experts.
  • The decision is issued, and the applicant can file an objection if rejected.
  • Accepted patents are published in the Industrial Property Gazette.

Note: Applicants have 90 days to complete missing documents, otherwise, the request is deemed withdrawn.

  • What is a Utility Certificate?

A utility certificate protects new inventions that are industrially applicable but lack the inventive step required for a full patent.

Protection Period:

10 years from the filing date.

Not eligible for utility protection:

Same exclusions as patents, including natural substances and scientific principles.

  • Industrial Designs

An industrial design refers to the decorative or aesthetic appearance of a product (2D or 3D) used in industrial or handicraft production.

Conditions for Protection:

  • The design must be new.
  • It must not violate public order or morals.

Duration of Protection:

20 years from the application date.

  • Layout Designs of Integrated Circuits

These are schematic arrangements of active components within a microchip that perform a specific electronic function.

Duration of Protection:

10 years from either the application date or first commercial use.

Assignment and Waiver of Rights

  • Assignment of patent or utility rights must be in writing and notarized.
  • Waiver must be officially notified to concerned parties and registered in the official record.

Invalidity and Compensation

  • Any interested party may challenge the validity of a granted patent or utility certificate if legal conditions are not met.
  • The patent holder has the right to claim compensation for infringement.

Penalties:

Anyone who files false or forged documents, copies inventions, or violates industrial property rights may face:

  • Imprisonment
  • A fine from AED 100,000 to AED 1,000,000
  • Seizure or destruction of infringing products and tools.
